United States Attorney Brendan V. Johnson announced that Michael Anthony Charging Elk, age 21, of Rosebud, South Dakota, appeared before United States District Judge Roberto A. Lange on February 15, 2012. Charging Elk pled guilty to Assault by Striking, Beating and Wounding. The maximum penalty upon conviction is 6 months' imprisonment, a $5,000 fine, or both, and a special assessment of $10 to the Victim Assistance Fund (VAF).
The charge stems from an incident that took place on August 26, 2011, when Michael Charging Elk went to the Sicangu Village housing in Todd County. Upon arrival, Charging Elk and a female began to argue. The victim went outside to assist the other female. Charging Elk punched the victim in the face several times.
The investigation is being conducted by Rosebud Sioux Tribe Law Enforcement Services. Special Assistant United States Attorney Matt Rappold is prosecuting the case.
A presentence investigation was ordered, and a sentencing date was set for May 1, 2012. The defendant was remanded to the custody of the United States Marshal pending sentencing.
